Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are a legally binding agreement between you and Corvidae Limited ("Corvidae", "we", "us", "our"), a New Zealand company, covering your use of DiggaPets, the game at app.diggapets.com, and this website (together, the "Service").

By playing DiggaPets or creating an account, you agree to these Terms. If you do not agree, do not use the Service.

2. Who can play

You must be 13 or older to play. By using the Service you confirm you meet this requirement. If you are under 18, make sure a parent or guardian is comfortable with you playing and with any purchase before it is made.

3. Your account

You can try the game without an account; an account saves your pet and progress. When you create one (with an email and password, or Google or Microsoft sign-in), you agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. Tell us promptly at [email protected] if you believe someone else has accessed it.

4. The game and virtual items

• Cytha crystals, minerals, energy, outfits, decorations, and every other in-game item are virtual items with no monetary value. They are not money, property, or an investment, and they never earn anything.
• Virtual items cannot be transferred, traded, sold, or redeemed for money or anything of value outside the game.
• We license virtual items to you for use inside the Service; we may adjust game balance, features, and content to keep the game working and fair. Paid cosmetic items you own stay yours for as long as the Service and your account exist.
• Energy is a pacing mechanic. It is never sold, and no paid refill exists.

5. Purchases

• DiggaPets sells a small number of one-off cosmetic and decoration packs. Nothing paid affects gameplay power, there are no lootboxes, and there are no subscriptions. Nothing auto-renews.
• Payments are processed by Stripe; we never see or store your full card details.
• Prices are shown before you pay and include tax where applicable.
• Items are delivered immediately to your account after payment.
• The shop is available in New Zealand, Australia, the United States, and Canada at launch. The EU and UK are coming soon.

6. EU and UK right of withdrawal

When the shop opens in the EU or UK: our packs are digital content delivered immediately. By purchasing, you expressly consent to immediate delivery and acknowledge that you lose the statutory right of withdrawal once delivery has begun. If something went wrong with a purchase, email [email protected] and we will look at it properly.

7. Refunds

Refund requests go to [email protected] and are handled in line with applicable consumer law, including the New Zealand Consumer Guarantees Act 1993 and the Australian Consumer Law. If a pack failed to deliver or delivered broken, we will fix it or refund it. Nothing in these Terms limits rights you have under consumer law that cannot be excluded.

8. Acceptable use

You agree not to:

• Use bots, scripts, or automation to play, or tamper with game data, clients, or network traffic
• Exploit bugs for advantage instead of reporting them to us
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service, its servers, or other players
• Buy, sell, or transfer accounts or virtual items outside the game
• Violate any applicable law or the rights of others

We may investigate suspected misuse and may suspend or terminate access to protect the Service and its players. Tampering with the Deep Descent or other validated gameplay also voids any related prize claim (see the Deep Descent rules).

9. Termination

We may suspend or terminate your access if you materially breach these Terms, commit fraud, or abuse the Service. Where reasonable, we will warn you first. You can stop using the Service at any time.

10. Account deletion

Account deletion is available in Settings, inside the game. Deleting your account removes all your game data: your pet, burrow, museum, purchases, and progress. Deletion is permanent, and virtual items are not refunded on deletion except where consumer law requires it.

11. Service availability and liability

The Service is provided "as is" and "as available". DiggaPets is a game; we do not guarantee uninterrupted operation, and real-time features depend on third-party providers (AWS hosting, Stripe payments) we choose carefully but do not control.

To the fullest extent permitted by law, Corvidae is not liable for indirect, incidental, special, or consequential damages, or for loss of data or virtual items caused by events outside our reasonable control. Our total aggregate liability in connection with the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or NZD $100 if you have paid nothing in that period. Nothing in these Terms limits rights under the New Zealand Consumer Guarantees Act 1993, the Australian Consumer Law, or other laws that cannot be excluded.

12. Changes to these Terms

We may update these Terms. Each version carries a version tag (this one is 2026-07-diggapets-1), and we will notify you of significant changes in the game or by email. Continued play after a change means you accept it. We will never use a terms change to add subscriptions, lootboxes, or paid power.

13. Governing law

These Terms are governed by the laws of New Zealand. If you have a dispute with us, contact us first; we genuinely try to fix things. Failing informal resolution, any legal action must be brought in the courts of New Zealand, except where the consumer law of your home country gives you the right to bring it there.
